These terms and conditions are subject to change without prior notice at any time, in Tannenbaums' sole discretion. By visiting, browsing, shopping, accessing or otherwise using the Site after a change has been posted to the Site, the Customer accepts that change. Acceptance of Contract Terms
This User Agreement, and all of its terms and conditions, constitute a legal contract between you and Tannenbaums ("Tannenbaums")(references to "you" or "your" shall relate to a customer of Tannenbaums or other party that visits, browses, quotes, orders, accesses or otherwise uses the Site (the "Customer"); references to "Tannenbaums" shall relate to Tannenbaums) By visiting, browsing, quoting, ordering, accessing or otherwise using this site ("Site"), you acknowledge that you have read, understood, and agree to be bound by this User Agreement and comply with all applicable laws and regulations, including U.S. export and re-export control laws and regulations. If you do not agree to this User Agreement, as it may be changed by Tannenbaums from time to time, do not use this Site. The material provided on this Site is protected by law, including, but not limited to, United States copyright law and international treaties. This Site is controlled and operated by Tannenbaums from its offices within the United States. Tannenbaums makes no representation that materials in the Site are appropriate or available for use in other locations, and access to them from territories where their contents are illegal is not authorized. Those who choose to access this Site from other locations do so on their own initiative and are responsible for compliance with applicable local laws.

Any claim relating to, and the use of, this Site and the materials contained herein is governed by the laws of the state of Utah without regard to conflict of law rules. You consent to jurisdiction of the federal and state courts located in Salt Lake County, Utah to hear any such claims.

Price quotes obtained on this Site are not legally binding on Tannenbaums until your order has been accepted.

Tannenbaums grants you a limited license to access and make personal use of the Site and not to download (other than page caching) or modify it, or any portion of it, except as provided below under "Use Restrictions," or with express written consent of Tannenbaums.

Shipping
Tannenbaums uses third-party service providers to deliver your order and is not liable for delivery problems caused by these providers. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.  These providers include, but are not limited to, United Parcel Service (UPS). Orders delivered through UPS are shipped by your chosen method upon time of order. UPS will deliver your order to the address identified as "Ship My Order To" on your order. The customer is responsible for checking all UPS shipments for damages upon delivery. Damaged shipments should be reported to the driver at the time of delivery and refused. Please call our Customer Support at 1-800-908-5671 to report any such damages as soon as possible. Tannenbaums is not responsible for any damage to orders caused by delivery providers that are not reported to the delivery provider at the time of delivery.

Product Descriptions
Tannenbuams attempts to be as accurate as possible. However, Tannenbaums does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free. If a product offered by  Tannenbaums itself is not as described, your sole remedy is to return it in unused condition.

Limitation of Liability
UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, SHALL Tannenbaums BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOSS OF DATA OR PROFIT, ARISING OUT OF THE USE, OR THE INABILITY TO USE, THE MATERIALS ON THIS SITE, EVEN IF Tannenbaums OR AN Tannenbaums AUTHORIZED REPRESENTATIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Returns and Refunds
Tannenbaums does not accept return of its products.  If your Tannenbaum's Christmas tree fails to meet the USDA premier of Grade One quality for fresh Christmas trees as guaranteed by Tannenbaums, Tannenbaums, upon receipt of written notice from you to that effect, will, at your option, either refund to you the purchase price of the Christmas tree or send to you a new Christmas tree of the same species and price as the Christmas tree originally sent to you. 

Privacy
Tannenbaums is committed to protecting your privacy and security. We will ensure that any information we obtain and use will always be held, used and transferred in compliance with all applicable data protection rules.

We will not pass on your details to anyone else without asking you first.

We do collate statistics about site traffic, sales and other commercial information which we pass on to trusted third parties to assist us in improving the service we provide to you. However, none of this information will identify individuals.

You may opt out of the various uses of your personal information at any time, even if you have previously given your consent for us to use them.

Security checks

As part of our policy to protect against the fraudulent use of credit cards, we carry out random security checks on orders. These can take various forms, and may involve contacting you by telephone before your order is processed. We hope you appreciate that these measures are a necessary precaution, undertaken in the interests of fraud prevention.

If you disagree with any of the terms and conditions of this User Agreement, please do not visit, browse, quote, order, access or otherwise use this Site. However we would still like to work with you to provide quality printing for your business.

Governing Law and Forum
This Agreement shall be governed by the laws of the state of Utah without giving effect to conflict or choice of law principles. Any litigation between the Parties shall be conducted exclusively in Utah state courts or the federal district courts within Utah and their respective appellate courts. The Parties agree and submit to such exclusive jurisdiction and venue.
